EFLANCERS – LEGAL POLICIES & USER AGREEMENT

This Agreement constitutes a legally binding contract between you (“User”, “Client”, or “Freelancer”) and EFlancers (“Platform”, “Company”, “we”, “us”). By accessing, registering, or using the Platform, you agree to be bound by these Terms.
SECTION 1 – TERMS OF SERVICE
1. Introduction
EFlancers is an online freelance marketplace that connects Clients with Freelancers. The Platform operates strictly as a neutral intermediary providing escrow-based payment facilitation.
EFlancers is not an employer, partner, joint venturer, contractor, or agent of any User.
If you do not agree, you must discontinue use immediately.
2. Eligibility
- Users must be at least 18 years old.
- Users must provide accurate and truthful information.
- The Platform reserves the right to suspend or terminate accounts involved in illegal, fraudulent, or abusive conduct.
3. Identity Verification (Mandatory)
To maintain security and regulatory compliance, Users may be required to submit valid government-issued identification before offering services or receiving payments.
Verification Requirements
- Passport, National ID, or Driver’s License
- Matching registered account name
- Additional verification (selfie, proof of address, payment verification) if required
Failure to verify may result in restricted or terminated accounts.
All documents are processed under the Privacy Policy.
4. Independent Contractor Status
All Freelancers are independent contractors and not employees of EFlancers.
EFlancers does not:
- Control how services are performed
- Supervise Users
- Set working hours
- Provide employment benefits
- Withhold taxes
Users are solely responsible for their own taxes, insurance, licensing, and compliance with applicable laws.
5. Platform Usage Rules
Users agree NOT to:
- Circumvent the payment system
- Conduct payments outside the Platform
- Engage in fraud, spam, harassment, or illegal activity
- Manipulate ratings or reviews
- Post unlawful or infringing content
Violation may result in permanent termination.
6. Payments & Escrow
- Clients must deposit full project funds into escrow via Stripe before work begins.
- Funds are held securely until completion and approval.
- Funds may auto-release if the Client fails to respond.
- Payouts are processed via Payoneer or bank transfer.
- Off-platform payments are strictly prohibited.
7. Fees
- Freelancer Fee: 10% per completed project
- Client Fee: 5% per completed project
- All service fees are non-refundable
8. Delivery & Acceptance
- Freelancers must deliver within agreed timelines.
- Clients must review promptly.
- Revisions must follow the agreed scope.
9. Intellectual Property
Ownership transfers to the Client only after full payment release.
Until then, rights remain with the Freelancer.
10. Onsite Work Disclaimer & Liability
If a Client requests services to be performed at a physical location (“Onsite Work”), the following terms apply:
- EFlancers acts solely as a digital marketplace and does not arrange, supervise, or control onsite activities.
- The Freelancer is an independent contractor and assumes full responsibility for personal safety, insurance coverage, tools, equipment, and compliance with local laws.
- The Client is solely responsible for providing and maintaining a safe working environment.
- EFlancers shall not be liable for any injury, accident, death, property damage, loss, theft, or other harm occurring during or related to Onsite Work.
- All onsite engagements are conducted entirely at the sole risk of the Client and Freelancer.
- Users agree to indemnify and hold harmless EFlancers from any claims, liabilities, damages, or legal actions arising from onsite work arrangements.
11. Account Suspension & Termination
EFlancers may suspend, restrict, or permanently terminate accounts for:
- Fraud
- Identity misrepresentation
- Payment circumvention
- Abuse of the dispute system
- Legal violations
12. Limitation of Liability
The Platform is provided “as is” and “as available.”
To the maximum extent permitted by law, EFlancers shall not be liable for:
- Indirect or consequential damages
- Lost profits
- Project failure
- User disputes
- Personal injury claims
- Onsite incidents
Total liability shall not exceed the total service fees paid to EFlancers.
13. Indemnification
Users agree to indemnify, defend, and hold harmless EFlancers, its owners, officers, and affiliates from any claims, damages, liabilities, costs, or legal expenses arising from:
- User misconduct
- Breach of this Agreement
- Onsite work arrangements
- Legal violations
14. Governing Law
The laws of the State of Delaware, United States, govern this Agreement.
Any disputes shall be resolved exclusively in the courts located in Delaware.
SECTION 2 – REFUND POLICY
- Platform fees are non-refundable.
- Refunds may be considered only if work has not commenced.
- No refund after delivery.
- Dispute decisions by EFlancers are final.
- Unauthorized chargebacks may result in legal action.

- Functional Cookies
- Security Cookies
Disabling cookies may affect functionality.
SECTION 4 – PRIVACY & CONTENT CONFIDENTIALITY
We collect:
- Registration details
- IP & usage data
- Platform communications
All project materials are confidential.
EFlancers may access content only for:
- Dispute resolution
- Fraud prevention
- Legal compliance
- Security investigations
SECTION 5 – DISCLAIMER
EFlancers is a neutral digital marketplace.
We do not guarantee:
- Project success
- Income
- Business results
Users act independently and at their own risk.
SECTION 6 – USER CONFIRMATION
By using EFlancers, you confirm:
- You are 18+
- You provide truthful information
- Payments must use escrow
- Fees are 10% (Freelancer) & 5% (Client)
- You accept Delaware jurisdiction
- You understand EFlancers is not liable for onsite incidents
