14. Content Privacy and Confidentiality

14.1 Confidential Content
All content, files, documents, project briefs, messages, media, or any other materials exchanged between Clients and Freelancers on the Eflancers platform are considered strictly confidential. Users agree not to disclose, share, publish, or distribute such content to any third party without the explicit written consent of the content owner.

14.2 Ownership of Client Content
Clients retain full intellectual property and proprietary rights over any materials or instructions provided through the Platform. Freelancers are prohibited from using, modifying, reproducing, or repurposing such content outside the scope of the agreed project, unless granted prior written permission by the Client.

14.3 Freelancer Deliverables
Any work or deliverables submitted by Freelancers remain their property until full payment has been released through the Platform’s escrow system. Upon payment completion, all intellectual property rights are transferred to the Client, in accordance with Section 11 (Intellectual Property Rights).

14.4 Non-Disclosure Agreement (NDA)
By using the Platform, both Clients and Freelancers automatically enter into an implied Non-Disclosure Agreement (NDA). Users must keep all project-related information confidential, even after the project is completed or the account is terminated.

14.5 Platform Responsibility
Eflancers acts solely as a neutral intermediary and does not claim ownership of any user-generated content. However, Eflancers reserves the right to access content strictly for dispute resolution, fraud investigations, legal compliance, or enforcement of platform policies.

14.6 Breach of Confidentiality
Any unauthorized access, use, or disclosure of confidential content constitutes a material breach of this Agreement and may result in immediate account suspension, loss of funds, and possible legal action. Users acknowledge they may be held financially liable for damages resulting from such breaches.

14.7 Data Retention and Deletion
Users may request the deletion of confidential content after project completion; however, Eflancers may retain copies for a limited period as required for legal compliance, dispute handling, or audit purposes.

14.8 No Guarantee of Absolute Confidentiality
While Eflancers implements industry-standard security measures, users acknowledge that no online platform can guarantee 100% confidentiality against cyber-attacks or data breaches. The Platform shall not be held liable for breaches beyond its reasonable control.
