EFLANCERS – LEGAL POLICIES & USER AGREEMENT

Governing Law: State of Delaware, United States**

This page contains all legal terms, user obligations, and compliance policies governing the use of the Eflancers Platform. By accessing or using any part of the Platform, you agree to be bound by the policies outlined herein.

SECTION 1 – TERMS OF SERVICE

1. Introduction

Eflancers is a freelance platform that connects Clients who need services with Freelancers who offer those services. The Platform operates as a neutral intermediary and provides escrow-based payment protection.

If you do not agree with these Terms, you must discontinue use of the Platform.

2. Eligibility

  • Users must be at least 18 years old.
  • Users must provide accurate registration information.
  • Eflancers may suspend accounts for fraudulent or harmful activity.

3. Account Responsibilities

  • You are responsible for maintaining your password and account security.
  • Account sharing or transfer is not allowed.

4. Platform Usage

Users agree not to:

  • Bypass Eflancers’ payment system
  • Post harmful or illegal content
  • Use the Platform for fraud, spam, or harassment

5. Payments & Escrow

  • Clients must deposit project funds into escrow before work starts.
  • Funds are released to Freelancers only after Client approval.
  • Payments outside the Platform are strictly prohibited.

6. Fees

  • Freelancer Fee: 20% per project.
  • Client Fee: 5% per project.
  • All fees are non-refundable.

7. Delivery & Acceptance

  • Freelancers must deliver work on time.
  • Clients must review and accept or request revisions.
  • If no response, funds may be auto-released.

8. Intellectual Property

  • Ownership transfers to the Client after full payment.
  • Freelancers retain rights until payment is released.

9. Account Suspension

Eflancers may suspend or terminate any account that violates these Terms.

10. Limitation of Liability

Eflancers is not responsible for indirect damages, loss of revenue, or project failure. The Platform is provided “as is.”

11. Governing Law

These Terms are governed by Delaware, USA. Legal disputes will be resolved in Delaware courts.

SECTION 2 – REFUND POLICY

1. General

  • All platform fees are final and non-refundable.
  • Refunds are only considered if work has not started.

2. No Refund After Delivery

  • If the Freelancer submits work, no refund is allowed.
  • If a Client uses or benefits from the work, refund is denied.

3. Dispute Process

  • Either party may open a dispute.
  • Eflancers reviews evidence and makes a final decision.

4. Chargebacks

Initiating a chargeback is a violation and may result in legal action.

SECTION 3 – COOKIE POLICY

1. Purpose

Cookies are used to improve user experience, security, and analytics.

2. Types of Cookies

  • Essential Cookies
  • Analytics Cookies (via Jetpack)
  • Functional Cookies
  • Security Cookies

3. Managing Cookies

Users may disable cookies in browser settings but this may limit functionality.

SECTION 4 – PRIVACY & CONTENT CONFIDENTIALITY POLICY

1. Data Collection

We collect:

  • Registration details
  • IP addresses (via Jetpack)
  • Usage data and analytics

2. Content Privacy

All files, messages, and project details are confidential. Users agree to:

  • Not share or exploit project content
  • Respect ownership rights
  • Abide by an implied NDA

3. Ownership

  • Clients own their content and delivered work after payment.
  • Freelancers own content until payment is released.

4. Platform Access

Eflancers may access content only for:

  • Dispute resolution
  • Legal compliance
  • Security investigation

SECTION 5 – DISCLAIMER & LEGAL NOTICE

  • Eflancers is a neutral platform, not an employer of Freelancers.
  • Users are responsible for their content and actions.
  • The Platform is not liable for the success or failure of any project.
  • Services are provided “as available” without warranties of any kind.

SECTION 6 – USER AGREEMENT SUMMARY (TL;DR)

You agree to confidentiality and legal compliance.

You must be 18+ and provide accurate information.

All payments go through escrow.

Fees: 20% Freelancer / 5% Client.

No refunds after work is delivered.

The Platform is not responsible for outcomes between users.
